By accessing and using this website, you agree to the terms of these Terms of Use and Sale ( “ Terms ” ) regarding the use of the website (Articles 2, 3 and 7-11 ). By purchasing a product, you also agree to the terms of these Terms regarding the purchase of products (Articles 2, 4-11 ) . If you do not agree to these Terms, you must stop using this website or refrain from purchasing our products.

To purchase products through this website, you must be of legal age in your country or region of residence.

2. Purpose and Scope

The following terms and conditions constitute a legally binding agreement between you ( “ you ” and “ your ” ) and MAPFOUR regarding your use of the website and your purchase of MAPFOUR products. In addition to these terms of use, your visit to the website and your purchase of MAPFOUR products are subject to our privacy policy and our cookie policy , which describe what personal data we collect and how we use and share it. The privacy policy and cookie policy form an integral part of these terms of use and should be understood in conjunction with them.   

In addition to these general terms and conditions, we ask you to read the relevant product descriptions on the website for specific features, technical data, prices, reviews, frequently asked questions, offers, and other useful information about each product. It is your responsibility to carefully read the product description and conditions before making a purchase.

All information relating to the purchasing process is provided to users in these general terms and conditions and on the website before the purchase begins. 

MAPFOUR stores the electronic document containing the contract and makes it available to users when necessary.

MAPFOUR provides you with these general terms and conditions free of charge before the conclusion of the agreement for the provision of services, in a way that allows you to consult, reproduce and store the content of these general terms and conditions using the ICT system (information and communication technology) you use.

3.1. Access to and use of the website

Our website is exclusively intended for users aged 18 and over.

Our products and services are exclusively intended for adults. You must have reached the legal age in the province or territory where you reside to make purchases on the website.

The use of MAPFOUR's services is possible provided that the ICT system you use meets the minimum technical requirements, such as access to the website via a web browser that can display HTML documents, and internet access.

To ensure the security of the transmission of messages and data related to the services offered on the website, MAPFOUR takes technical and organizational measures that are adapted to the level of threat to the security of the services offered, in particular measures to prevent unauthorized persons from accessing or modifying personal data transmitted over the Internet.

To create an account, you must provide your first name, last name, and email address, and choose a password.

You are responsible for the confidentiality of your account and password and you accept responsibility for all activities associated with your account or password. You also agree to ensure the accuracy and timeliness of this information at all times. If you have reason to believe that your account is no longer secure and/or has been compromised (for example, in the event of loss, theft, or unauthorized disclosure or use of your account ID or password), you must immediately notify MAPFOUR at [official@mapfour.com]. The account is created for an indefinite period. MAPFOUR offers account creation and its use free of charge.

 

3.3. Terms of Use and Restrictions

You can consult the website to view, request and use the available information, services and functions.

You may use the website exclusively for the purposes mentioned above, subject to the general terms and conditions set out herein and all applicable laws and regulations.

If you do not comply with the above provisions, MAPFOUR reserves the right, without prior notice, to take all measures it deems necessary to assert and defend its rights and prevent such unauthorized use. These measures include, but are not limited to, blocking your access to and/or your account on the website, the use of blocking technologies and/or initiating legal proceedings.

In particular, but not exclusively, you agree to refrain from the following:

•  Using the website in a way that violates applicable laws or legally binding regulations, the rights of third parties (in particular, but not exclusively, personal rights, data protection rights and copyrights) or good faith, public morality or public order, including supporting or promoting criminal or illegal activities, or spreading racist, xenophobic, violent, malicious, rude, obscene or unlawful content.

•  Using the website in a way that undermines its intended purpose (consulting, requesting and using the information, services and functions available on the website), or using the website for purposes other than private, non-commercial use, unless MAPFOUR has expressly authorized this in writing.

•  Using the website in a way that interferes with or disrupts the operation of the website, its servers, systems or networks, or engaging in activities that could lead to an unnecessary or disproportionate overload of the website's infrastructure, including, but not limited to, transmitting, installing or publishing viruses, malicious code or other harmful programs or files that cause damage, interruptions, inefficiencies or disruptions in the operation of the website or on third-party equipment, as well as retrieving or attempting to access material or information that has not been intentionally made available or provided through the website.

•  It is prohibited to advertise, promote or offer products and/or services for commercial purposes, if this is not expressly permitted or if these products and/or services compete with the trademarks displayed on the website.

•  Collecting personal data of other users of the website in any way without their express consent, or disclosing information that directly or indirectly allows the identification of a person without their express consent.

•  The use of systems or software to extract content, elements, materials, functions, information or data from the website, regardless of whether this is for commercial or other purposes ( " screen scraping " ).

3.4 . Termination

You can cancel your account at any time free of charge by sending a message to MAPFOUR at [ official@mapfour.com ] or by using the LiveChat. All personal data and the user account will then be deleted. You can find more information in our Privacy Policy and our Cookie Policy . 

MAPFOUR has the right to terminate the agreement for the provision of services with immediate effect, including the deletion of the user account, in the cases mentioned in the section above “ 3.3. Terms of Use and Restrictions ” .

4. Purchase a Product

4.1. Placing an order

To place an order, you can browse the catalog on the website and add the desired products to your shopping cart. The number of selected products will be displayed in your shopping cart as you continue to browse. You can also click on the shopping cart to view its contents on the screen, including all ordered items, the total amount, available payment methods, and any additional costs. You can then continue browsing the website, knowing that the selected products have been correctly stored in your shopping cart.

Prices are stated in the respective national currencies and include applicable taxes.

By clicking on the shopping cart or selecting a quick checkout option, you will enter the ordering process. 

If you have chosen the quick checkout option, you must complete the payment process through our partners. This involves entering your login details and filling in the relevant fields. More information about the processing of personal data by the respective payment service providers (our payment partners) can be found in their privacy policies. 

You can log into your account before checkout or checkout as a guest. To complete your order, you must provide your delivery address, delivery region, and the necessary information for payment via your chosen payment method. Available payment methods, delivery terms, warranty information, and any delivery restrictions for your region will be displayed during the checkout process.

Your order constitutes an offer to MAPFOUR to enter into a purchase agreement. When you place an order for a MAPFOUR product, you will receive a confirmation email with the details of your order. This order confirmation is not an acceptance of your offer, but only serves to inform you that we have received your order. A purchase agreement is only concluded when we ship the ordered product to you and confirm the shipment with a second email or a message in your customer account.

4.2. Payment, contract conclusion, and order confirmation

Before you can click the relevant button to purchase, you must read and accept these terms and conditions by performing a confirmation action on the website (for example, by ticking a box).

If you have chosen a fast checkout option, you will be redirected to our partner's payment page after agreeing to these terms and conditions. 

Your order is completed by clicking the corresponding button. You will then receive a confirmation email. You agree that we may send you an electronic invoice upon request. Please contact us at [official@mapfour.com] if you would like to receive an electronic invoice or prefer a paper invoice. 

After you place your order and confirm payment in accordance with these terms and conditions, an order confirmation will appear on your screen, and you will receive an email that you can print and download. This email confirms that your order has been placed and contains, among other things, the following information: the name and contact details of MAPFOUR, an overview of the order including any costs and restrictions, the total order amount including VAT, and a payment confirmation. MAPFOUR retains ownership of the ordered products until the full price, including any additional costs and shipping costs, has been paid. In case of non-payment, you agree to return the received products to MAPFOUR at your own expense upon request.

To protect MAPFOUR from misuse by fraudsters, and in the event that MAPFOUR or the online payment service provider suspects a fraudulent order, we reserve the right to ask you (before processing the order) to provide additional proof (including your identity document) to verify whether or not fraud has occurred.

If the buyer does not respond to the request from MAPFOUR or the online payment service provider within fifteen (15) days, the order will be cancelled, and MAPFOUR will not receive payment. If payment for the order has already been received, MAPFOUR will refund it via the same payment method after the aforementioned period.

In any case, MAPFOUR reserves the right to refuse orders or deliveries if (i) there are still outstanding disputes with you; (ii) previous orders from you have not been paid in full or in part; and (iii) payment for the order has not been received or has only been partially received.

4.3. Product Unavailability

If a product is unavailable, you will be notified during the ordering process – MAPFOUR will then display a message that the desired product is temporarily unavailable – or MAPFOUR will send you a message via the email address you provided after order confirmation.

If, after confirming your order, one of the products is no longer available, it will be removed from the order, and the corresponding amount will be refunded to you. More information about the refund procedure can be found in section " 6.3. Refund Policy " .

5th Delivery 

Once your order is ready, it will be shipped to the postal address you provided during checkout. MAPFOUR uses external logistics service providers for handling deliveries and returns. Information about their shipping policy can be found at [ https://mapfour.com/pages/shipping-policy ].

Delivery information, including all associated costs and restrictions, will be displayed during the order process and in the order confirmation. More information can be found in our shipping policy and our return and refund policy .

A delivery is considered complete once the carrier makes the products available to you or a third party designated by you. It is your responsibility to check the delivered products immediately upon receipt for damage, defects, and their soundness.

6. Returns, Remedies for Breach of Contract, and Refunds 

Once the delivery is complete, the following options are available to you:

 You can return the products within the periods specified in our shipping policy by revoking the agreement ( " Right of Withdrawal " ) from the delivery date and requesting a refund. Please note that costs may be associated with this.

If  you find upon delivery that the products do not conform to the agreement, you can request a repair, replacement, or partial refund within the period applicable in your country. More information and the period applicable in your country can be found in our warranty conditions .

6.1. Right of Return

Right of Withdrawal

You have the right to withdraw from the agreement within the periods set out in our return and refund policy without giving reasons. The withdrawal period begins on the day on which you or a third party designated by you, who is not the carrier, physically takes possession of the goods. 

If multiple products are placed in one order, some of which are delivered on different days, the cooling-off period begins on the day on which you or a third party designated by you, who is not the carrier, physically takes possession of the last product.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this agreement by means of a clear statement (for example, by email or live chat). You can use the model withdrawal form below, but this is not mandatory.

To comply with the withdrawal period, it is sufficient that you send your notification of exercising your right of withdrawal before the withdrawal period expires.

Withdrawal Symptoms

If you withdraw from the agreement, we will refund all payments received from you in accordance with our return and refund policy, without undue delay from the day on which we are informed of your decision to withdraw from the agreement. Please note that you may have to pay certain costs. For more information, please consult our return and refund policy . We will make the refund using the same payment method you used for the original transaction unless you have expressly agreed otherwise.

Once we have received your decision, we will send you an acknowledgment of receipt by email or LiveChat with the following information:

•  Return label: A label with the address of the fulfillment center that will receive and process the return. Affix this label to the return package. You can choose your preferred shipping partner and must return the products in accordance with our return and refund policy . Please refer to our return and refund policy for more information.    

You must return the products as soon as possible after the day on which you informed us of your decision, if possible in the original packaging. 

Exercising this right does not entail any liability on your part. However, we reserve the right to charge processing fees for the return. Please refer to our terms and conditions for more information. More information can be found in our return and refund policy. You are only liable for any diminished value of the products resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the products.   

Once the package has arrived at our logistics centers, the refund procedure will begin. More information about the refund procedure can be found in section " 6.2. Refund Policy " . 

6.2. Refund Policy

If you request a refund based on your right of withdrawal or our warranty conditions, we will immediately refund all payments received from you in accordance with our return and refund policy, as soon as we have been notified of your decision, provided we have received proof that the products have been returned to us. However, we may withhold the refund until we have received the returned products. If we do not receive proof that the products have been returned to us, the fourteen (14) day period begins on the day we receive the products. Please note that a processing fee will be charged for the return. Before we proceed with the refund, we will inspect the returned products to assess your claim, specifically:

If  you return the products within the period indicated in our return and refund policy and request a refund, we will check whether the products are in the same condition as when we sent them to you. If we determine that the value of the products has diminished due to your use to such an extent that it is no longer necessary to ascertain the nature, characteristics and functioning of the products, we reserve the right to deduct the corresponding amount from the final refund amount .

If  you request a price reduction due to breach of contract, we will determine the depreciation by calculating the difference between the value the products would have had at the time of delivery if they had been in conformity with the contract and the value the products actually had at the time the contract was concluded.

If  you request a refund due to breach of contract, we will check whether it is a minor breach; if so, we will offer you another, more suitable solution from the options mentioned above.

We will refund the amount to you using the same payment method you used for the original transaction, unless otherwise agreed. We cover all costs associated with the procedure due to breach of contract. As part of the return procedure, we will reimburse you for all costs, with the exception of (i) the applicable administrative fees for the return and (ii) any additional costs incurred because you chose a different shipping method for the return than the most economical standard shipping option offered by MAPFOUR.

7. Warranties and Liability

The provisions of this article apply to the extent permitted by mandatory applicable law. This article is not intended to limit our liability, nor does it limit it, to the extent that we are liable to you under law or under any legal rights to which you are entitled.

Some countries or jurisdictions do not allow the limitation or exclusion of certain warranties. You may have other rights, which vary by jurisdiction.

7.1. Products

Provided that MAPFOUR delivers products in accordance with the agreement, MAPFOUR does not guarantee that the products offered on the website will meet your specific personal wishes or expectations or that you will like them, unless you have informed us of this and we have agreed to deliver a product according to your personal specifications. 

7.2. Your representations and warranties

You affirm, declare and agree that: 

You  will not use the products in any way that (i) infringes, disregards or misuses the intellectual property rights or other rights of MAPFOUR or third parties; (ii) violates, or would cause MAPFOUR to violate, applicable laws or regulations, or for any illegal purpose; (iii) violates these terms and conditions; or (iv) in any way jeopardizes the security of your account, the website or yourself. 

You  agree to comply with applicable laws and regulations when using the website and products.

•  provided that the products are intended for personal, non-commercial use and that you do not rent, lease, lend, sell, resell, sublicense, distribute, transfer or otherwise make the products available, unless expressly permitted . 

You are  not permitted to allow others to access your account or the accounts of others without permission, to create accounts using bots or other automated means, or to engage in other fraudulent activities.

 You may not modify or adapt the products or parts thereof, nor create derivative works or parts thereof, unless expressly permitted by MAPFOUR or the foregoing restriction is expressly prohibited by applicable law (in which case you must contact MAPFOUR in writing to announce the planned action and clarify whether MAPFOUR is willing to provide the desired derivative works) .

8. Intellectual Property

8.1. Intellectual Property

For the purposes of these terms and conditions, and in particular this article, the term ' intellectual property ' includes, but is not limited to, patents, utility models, designs, trademarks, trade names, company names, logos, domain names, copyrights and related rights, databases, software, hardware, circuit diagrams or schematics, trade secrets and know-how. When referring to intellectual property rights, this includes proprietary rights or rights of equivalent effect in any part of the world and all rights thereto (whether registered, registrable or not), as well as applications, registrations, extensions and renewals relating to these rights in any part of the world.

The website contains content, elements, materials, features or information (for example, but not limited to, visual user interfaces, graphics, designs, compilations, computer code – including source or object code – and instructional videos) that are subject to intellectual property rights and laws (hereinafter collectively referred to as " Content " ). You understand and acknowledge that MAPFOUR owns the exclusive proprietary rights, or has the applicable licenses or rights, to the intellectual property rights of the website and its Content.

In some cases, the website may contain third-party content protected by the intellectual property rights of those third parties. To the extent permitted by applicable law, MAPFOUR is in no way liable for third-party content on the website, including, but not limited to, errors or omissions in the content or any loss or damage of any kind arising from the use of such content.

You are hereby granted permission to view the website and its content, limited to what is strictly necessary to do so in accordance with these terms and conditions. Nothing in these terms and conditions or on the website shall be construed as granting, by implication or otherwise, any license or right to use the intellectual property of MAPFOUR or a third party displayed on the website or in its content, except as expressly stated herein; otherwise, in each individual case, our prior written consent is required. MAPFOUR reserves all rights to the intellectual property, the website and its content not expressly granted herein.

8.2. User-Generated Content

We may offer sections on the website where users can upload, submit, share, display or otherwise publish content such as text, comments or opinions, feedback, information, data, photos, videos, etc. (hereinafter referred to as " user-generated content " or " UGC " ).

You are solely responsible for all user-generated content that you upload to the website. By uploading content to the website, you declare that you have obtained all necessary permissions, licenses or rights and hereby grant MAPFOUR, to the extent permitted by law, a royalty-free, non-exclusive, sublicenseable, transferable, worldwide license to use this UGC, including but not limited to reproducing, modifying, publishing, translating, creating derivative works, distributing, performing or displaying this UGC, in whole or in part, in any form, in all media or technologies now known or hereafter developed, for any purpose, including but not limited to advertising and promotional purposes.

To the extent permitted by applicable law, you agree to indemnify and hold MAPFOUR harmless from and against all liabilities and costs, including but not limited to reasonable attorneys' fees, arising from or related to claims arising from or related to user-generated content (UGC) uploaded by you to the website. You are obliged to provide all reasonable cooperation in the defense against such claims. MAPFOUR reserves the right, at its own expense, to assume the exclusive defense and control of all matters falling under your indemnity.

MAPFOUR reserves the right (but is not obligated) to refuse, block or remove user content that violates the above provisions, in whole or in part, from the website.

10. Miscellaneous 

10.1. Changes to the Terms and Conditions. MAPFOUR may change the content of these Terms and Conditions from time to time to

a)  adapt the terms to current or future legal or regulatory provisions;

b)  adapt the general terms and conditions to decisions of courts, consumer organizations or agencies or other competent authorities regarding the website, its content or the products offered thereon;

c)  prevent abuse or damage or for security reasons;

d)  take into account any changes in law, updates, improvements or changes to the services, products, website and/or their content.

MAPFOUR will inform you of any changes to these general terms and conditions that affect the rules for using the website by means of a general notice on the website before they come into effect, unless MAPFOUR is legally obliged to implement the changes immediately or within a shorter period. If you do not accept the new general terms and conditions, you must stop using our website. If you continue to use the website after the announced changes have come into effect, this will be considered your acceptance of the proposed changes.

If a change relates to provisions regarding the purchase and return of products, these changes will not apply retroactively and will not affect purchases you have previously made through the website, unless such changes must apply retroactively under applicable law or a decision of a government or judicial body; in that case, the changes will also apply retroactively to previously made purchases. Otherwise, you are bound by the version of the Terms of Use that was in effect at the time of each purchase.

According to the previous regulation, changes to the provisions of the privacy policy and cookie policy did not have to be notified, unless the change related to the processing of personal data in connection with the purchase of products.

10.2. Severability clause. If any provision of these Terms and Conditions or its application to a party or cause of action in a particular jurisdiction is limited, prohibited or unenforceable, that provision shall be void in that jurisdiction, without affecting the validity or enforceability of the remaining provisions of these Terms and Conditions in any other jurisdiction or their application to other parties or causes of action. To the extent possible, such provision shall be applied in full as permitted by law and, where necessary, shall be interpreted and applied to a more limited extent to ensure its validity.

11. Applicable Law and Jurisdiction

These general terms and conditions are governed by and shall be construed in accordance with the laws of your place of residence.

For all disagreements, claims or disputes arising from or related to these general terms and conditions, MAPFOUR and you submit to the jurisdiction of the courts of your place of residence.
